Terms of Service (awesome-nano-banana)

1. Introduction

Welcome to awesome-nano-banana (the “Service”), operated by awesome-nano-banana (“we”, “us”, “our”). By accessing or using the Service, you agree to be bound by these Terms of Service (the “Terms”). You must be at least 18 years old to access or use this Service. If you do not agree to these Terms or are under 18, do not use the Service.

2. The Service

• awesome-nano-banana provides AI-powered text-to-image generation tools. Registered users can input text prompts to generate images using various AI models.
• Credits System: The Service operates on a credit-based system. Actions such as generating images or upscaling require credits, which may be granted daily (for free users) or purchased via subscriptions.
• Availability: We may change, suspend, or discontinue parts of the Service (including specific AI models) at any time. We provide reasonable efforts to maintain availability but do not guarantee uninterrupted access.

3. Eligibility & Accounts

• Age Restriction: Due to the unrestricted nature of the AI models used, you must be at least 18 years of age to use the Service. By creating an account, you strictly warrant that you are 18 or older.
• Account Security: Registration is required to generate images. You agree to provide accurate information and keep your credentials confidential. You are responsible for all activities under your account. Notify us immediately of any unauthorized use.

4. Privacy

Your use of the Service is subject to our Privacy Policy, which explains what we collect (prompts, generated images, account data), how we share data with AI inference providers (e.g., Fireworks AI, DeepSeek) for generation and translation purposes. By using the Service, you acknowledge the Privacy Policy.

5. Your Content (Prompts & Images)

• Ownership: As between you and us, you own all rights in the text prompts you input and the images generated for you, subject to the license below.
• License to awesome-nano-banana: You grant us a non-exclusive, worldwide, royalty-free license to host, store, copy, display, and reproduce your Content (prompts and images) for the purpose of providing the Service.
• Public Gallery & Privacy:
  • Free Users: Content generated by users on the Free Plan is Public by default. You grant us the right to display these images in our Public Gallery and use them for SEO and marketing purposes.
  • Paid Users: Users on Pro or Ultimate plans may choose to generate images in “Private Mode.” Private images will not be displayed in the Public Gallery.
• Content Retention: We store your generation history to provide the “My Creations” feature. We retain this data until you delete your account or delete specific images.

6. Acceptable Use & Content Policy

While awesome-nano-banana allows for broad creative freedom, strict legal and safety boundaries apply. You agree NOT to use the Service to generate, upload, or share:

• CSAM (Child Sexual Abuse Material): Any content depicting minors in sexual scenarios. Zero tolerance; we report to NCMEC.
• Non-Consensual Deepfakes: Realistic images depicting real people (public figures or private individuals) in sexual, compromising, or defamatory scenarios without their consent.
• Illegal Content: Content that violates applicable laws.
• Automated Abuse: Attempting to scrape the Service or bypass credit limits via scripts.

We reserve the right to suspend or ban users immediately for violations.

7. Third-Party Services & AI Providers

To operate the Service, we rely on third-party infrastructure: Fireworks AI, Novita.ai (image generation); DeepSeek (translation); Supabase, Vercel (hosting & DB); Stripe (payments). Your prompts are sent to these providers for processing. We are not responsible for their availability or policies.

8. Plans, Fees & Refunds

• Subscriptions: Monthly and Yearly, as shown on the Pricing page (prices may change with notice).
• Credits Expiration:
  • Free Daily Credits: Reset every 24 hours (UTC 00:00), no rollover.
  • Subscription Credits: Reset at the end of each billing cycle, no rollover.
• Refunds: GPU costs are incurred immediately on generation; all fees are non-refundable except where required by law. Cancel anytime to stop future billing.

9. Intellectual Property

Our IP: the Service interface, software, website design, trademarks, and the “awesome-nano-banana” brand. Your IP: your prompts and generated images, as described in Section 5.

10. Accuracy & AI Disclaimer

• Probabilistic Nature: AI generation is probabilistic and may produce artifacts or results that do not match your prompt.
• No Professional Advice: The Service is for entertainment and creative purposes only.

11. DMCA / IP Complaints

If you believe material in our Public Gallery infringes your copyright, email support@fotofox.ai with a DMCA-style notice. We will remove infringing material and terminate repeat infringers.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted with the “Last updated” date. Continued use after changes means you accept the updated Terms.

13. Suspension & Termination

We may suspend or terminate your access (with or without notice) if we reasonably believe you violated these Terms (especially Section 6 regarding CSAM or deepfakes), or failed to pay fees.

14. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE AI-GENERATED CONTENT WILL MEET YOUR REQUIREMENTS OR BE OFFENSIVE-FREE.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM.

16. Governing Law

These Terms are governed by the laws of England & Wales / State of Delaware, without regard to conflict-of-law rules.
